Florida Sues Stake.us and VGW's Chumba Casino, Global Poker

Florida's attorney general sued Stake.us and VGW - the operator of Chumba Casino, LuckyLand Slots and Global Poker - in Hillsborough County circuit court on August 19, 2026, and because neither complaint asks for an emergency order, nothing filed that day forces any of those sites to stop taking Florida players.

This is the largest state action against the sweepstakes model so far, and it did not come from a legislature. Florida has no sweepstakes ban on its books. Three ban bills - HB 189, SB 1580 and HB 591 - all died when the session adjourned on March 13, 2026, which is why our Florida legality page still lists the state as open. The attorney general's answer is that no new ban was needed, because the existing gambling statutes already cover it. What did Florida file, and in which court?

We pulled both complaints from the attorney general's own site rather than working from the write-ups. They were filed in the Circuit Court for the Thirteenth Judicial Circuit, Hillsborough County, and the electronic filing stamps put them two minutes apart on the morning of August 19, 2026: filing number 255161948 at 08:52:27 for the VGW case, and 255162092 at 08:54:03 for the Stake case.

Both are state-court cases, not federal ones. Each carries two counts: forfeiture and recovery of money lost gambling under sections 849.12 and 849.29 of the Florida Statutes, and violation of the Florida Deceptive and Unfair Trade Practices Act. We covered what the forfeiture count is actually asking for separately, because it is the part with the most direct bearing on player money.

Only the last of those is still a deadline a player can act on, and it does not come from this case.

Which brands and companies are named as defendants?

The two complaints between them name four websites and a long list of companies.

Two details there are worth pulling out. The Stake complaint names two individuals as defendants alongside the companies, which is unusual in this beat, and it names Kick Streaming, the livestreaming platform the complaint describes as wholly owned by the same group. Five payment companies are also defendants. Florida named the payment processors too, and that is the part of this with consequences outside Florida.

The VGW complaint also lists Luckylandcasino.com among the sites it says the VGW defendants own and operate. That does not match what we found when we read the terms documents in August: LuckyLand Casino's own terms name a Malta company, Beells Ltd, and we set out why the two LuckyLand sites are not the same operation. The complaint is an allegation, not a finding, and the state has not yet had to prove the ownership it asserts.

What does Florida say these casinos did wrong?

The core allegation in both complaints is that the dual-currency structure is a disguise. According to the VGW complaint, "Sweeps Coins are a proxy for real money," and the filing works through the arithmetic: a $20 purchase returns five million Gold Coins and 20.50 Sweeps Coins, and Sweeps Coins redeem at one US dollar each. Attorney General James Uthmeier, in the written news release: "If it looks like a casino, takes real money like a casino, and pays out like a casino, it is a casino - and it is illegal under Florida law." A shorter version of the same line went out on his X account and is the one most TV coverage carried; the wording above is the office's own release.

The complaints also allege deceptive marketing, pointing at "free," "100% safe," and "100% legal" claims on the sites, at celebrity and influencer promotion, and at the selective publicising of large winners. Both filings cite the operators' own responsible-gambling pages as an admission that real gambling harm is possible on the platforms.

These are allegations. Neither company has answered the complaint, and Local 10 reported on the day of filing that attorneys for the companies could not be reached for comment. We found no statement from VGW or Stake in response, and we will update this piece if one appears.

Can Floridians still play right now?

For two of the four named sites, yes, and we checked those two ourselves rather than assuming. We read Chumba Casino's and Global Poker's own geo-block notices on August 19, after the filings. Both list the same two tiers of restriction, sixteen states in total, and Florida is in neither tier:

• Currently not available: Connecticut, Delaware, Michigan, Montana, Nevada, Washington
• Gold Coin free-to-play only, sweepstakes not available: California, Idaho, Indiana, Louisiana, Maine, Mississippi, New Jersey, New York, Tennessee, West Virginia

The other two we cannot say the same about. Stake.us blocks our reads of its state documents, so for that brand we are relying on the state's own allegation that it operates in Florida rather than on anything Stake publishes. And LuckyLand Slots is in the middle of shutting down entirely, which makes "still available" the wrong question for it - see the deadline below.

A lawsuit is not an injunction. We read both prayers for relief in full, and neither asks for a temporary restraining order or a preliminary injunction: the state wants a permanent injunction at the end of the case, not an order this week. Nothing filed on Wednesday forces any site to stop taking Florida players. What it does mean is that a Florida balance now sits inside an active enforcement action, which is a different risk from the one you had on Tuesday.

What should I do if I have a balance at a named site?

Get it out rather than sitting on it. That is the same advice we gave players in states with dated deadlines, and past exits show why: VGW's own state withdrawals gave players between 14 and 57 days to cash out, which is not long if verification is still outstanding. The reasoning holds here even without a deadline, because redemption is the one step that converts an account balance into your money. Check what you are actually holding first. A footnote in the VGW complaint records the floors: Chumba Casino allows gift-card redemption at 10 dollars and cash payouts at 100 dollars, and the other VGW sweepstakes sites require 50 Sweeps Coins. One deadline is real and already running. LuckyLand Slots is closing regardless of this case: gameplay ended on August 24 and the last redemption request has to be in by September 14, per the shutdown timeline we published.
