Stake.us New Jersey Class Action Stayed, Mediator Appointed

The New Jersey class action against Stake.us was stayed on September 18, 2026, and a mediator appointed to it. Both reached the docket as one entry carrying two clerk events - an order appointing a mediator, and a case-stayed flag - hours after the 10:00 a.m. telephone conference. Nothing has been settled, nobody has paid anyone, and no Stake.us account changes today. What changed is the track the case is on.

The case is Nufio v. Sweepsteaks Ltd., No. 3:26-cv-08394 in the District of New Jersey, before District Judge Robert Kirsch and Magistrate Judge J. Brendan Day. Sweepsteaks Ltd. is the corporate defendant behind Stake.us. We read the federal docket directly and confirmed the timing against the district court's own filing feed, which is how we check everything we publish.

What did the Stake.us docket show on September 18?

Two entries, both dated September 18:

Entry 26 is the minute entry for the call itself, which the judge had set for 10:00 a.m. ET. Entry 27 landed a little under three and a half hours later and is one docket entry carrying two clerk events at once: the substantive one, an order appointing a mediator, and the administrative one, the flag that sets the case status to stayed.

Both entries are bare on the free public mirror. There is no description text and no downloadable document, so the mediator's name, the mediation deadline and the terms of the stay are not public yet. We are reporting the clerk's event labels, not the contents of an order we have not read. The district court's electronic filing feed carries the identical labels against the same entry numbers and timestamps, which is a second, independent observation of the same event rather than a second reading of the same page.

How did the New Jersey case get to mediation?

This is the outcome of a sequence our earlier report on the September 18 call was written ahead of. On September 10 Judge Kirsch entered a text order whose operative part reads, word for word:

Pursuant to the Telephone Conference conducted today, the Court hereby sets this matter for a Telephone Conference for 10:00 a.m. on Friday, September 18, 2026, to discuss further the early resolution of this case. In the interim, all deadlines for Defendants Sweepsteaks Ltd. d/b/a Stake.us and Kick Streaming Pty Ltd. to answer or otherwise respond to the Complaint pursuant to Federal Rule of Civil Procedure 12 are hereby STAYED.

That was a freeze on the answer clock. Today's entry is broader: the case itself is flagged stayed, and a mediator has been appointed to run the discussions the court called "early resolution" eight days ago.

The whole sequence, in four dates:

1. July 8, 2026 - the defendants file a notice of removal that moves the case out of Monmouth County Superior Court and into federal court in New Jersey.
2. September 10, 2026 - after a telephone conference the same day, Judge Kirsch stays the defendants' deadline to answer the complaint and sets a second call for September 18.
3. September 18, 10:00 a.m. ET - that call goes ahead; its minute entry reaches the docket at 14:36:26 GMT.
4. September 18, 17:55:48 GMT - one entry, two events: an order appointing a mediator, and the case-stayed flag.

How is New Jersey different from the other Stake.us lawsuits?

Because of what this docket still does not contain. In every other Stake.us class action we have covered, the spine of the case has been the same fight over whether players belong in court or in private arbitration:

That last row is a scan rather than an impression: the word "arbitration" returns zero hits across all 27 entries and the clerk's unnumbered text in between. Twenty-seven entries in, the defendants have never asked this court to send the case to arbitration. They have instead spent ten days in conferences about resolving it, and the court has now put a mediator on it. That is a materially different posture from the rest of the docket set, and it is the reason this one is worth watching.

What should a Stake.us player do now?

Nothing that this order asks of you. A mediation referral is not a settlement, a settlement fund, a claims process or an admission. There is no claim form, no deadline and no money attached to any of this, and anyone telling you otherwise is ahead of the record. If a settlement is reached it has to be filed, and a class settlement also has to be approved by the judge in public before a single payment is made.

But there is one clock the stay does not touch, and it is yours rather than the court's. Count V of this complaint is built on N.J. Stat. section 2A:40-1, and section 2A:40-5 gives a loser that civil action only "provided such action is brought within 6 calendar months after payment or delivery". That window runs from each payment you made, not from the filing of a class action and not from a judge staying the case. Money you paid more than six calendar months ago is already outside it, and a stay in Nufio does not hold it open. Whether any of it is worth pursuing is a question for a lawyer, not for us.
